What happened

EPA Administrator Lee Zeldin visited Wyoming on September 3, 2025, to announce that the EPA is proposing to approve Wyoming’s request to take primacy over its own Coal Combustion Residuals (CCR) program, according to the EPA’s upload of his remarks. Zeldin said Wyoming has been trying for years, as he put it, “to take primacy, to take control over its own destiny in overseeing Coal Combustion Residuals, the CCR program,” and that approval would make Wyoming the fifth state in the country to have primacy over its CCR program.

Zeldin said Wyoming’s leadership in pursuing the approval represents a model for the rest of the country. The next step, as he stated it, is a 60-day public comment period, and he encouraged participation in it, saying the EPA aspires to transparency and public input in these decisions. He closed by asking Wyoming’s leaders and people to tell the agency everything it can fix — “no ask is too large, no ask is too small,” as he put it.

Why it matters

State primacy over the CCR program — the federal rules for coal-ash disposal — is the cooperative-federalism pillar of Zeldin’s “Powering the Great American Comeback” agenda in action: a state taking over day-to-day oversight of a federal program inside its own borders, with the EPA in an approval and support role rather than the operator.
