What happened

HUD announced that Secretary Scott Turner will terminate the Biden-era 2021 Affirmatively Furthering Fair Housing (AFFH) rule. HUD characterized the rule as, in effect, a ‘zoning tax’ that raised costs and reduced the supply of affordable housing through restrictions on local land, and said terminating it cuts red tape imposed on localities and returns decision-making power to local and state governments. In the statement HUD published, Turner said local and state governments understand their communities’ needs better than Washington bureaucrats, and that localities would no longer be required to complete onerous compliance paperwork; under the action, a locality’s certification that it has affirmatively furthered fair housing under the Fair Housing Act would be deemed sufficient.

Why it matters

AFFH has been written, terminated, restored and terminated again across administrations; Turner’s action is the housing deregulation centerpiece of his first month and the clearest statement of his local-control approach to land use and zoning.
