What happened
HUD announced that Secretary Scott Turner issued an order directing the department to halt any pending or future enforcement actions related to HUD’s 2016 rule entitled ‘Equal Access in Accordance With an Individual’s Gender Identity in Community Planning and Development Programs.’ HUD stated that the action ensures housing programs, shelters and other HUD-funded providers offer services based on sex at birth. In the statement HUD published, Turner said he was directing staff to halt enforcement of the 2016 Equal Access Rule and described the action as carrying out the mission the President laid out on January 20, 2025 in an executive order on biological sex; he also said HUD would take inventory of its programs to ensure spending advances the department’s housing mission.
Why it matters
The order was one of Turner’s first regulatory actions and an early test of how far the administration’s January 20 executive order on sex would reach into housing programs, shelters and other HUD-funded providers.
